This document constitutes both our Privacy Policy and binding Terms of Service. By accessing
and using the Alpha Estimation website (https://www.alphaestimation.com) and our estimation
services, you acknowledge and agree that this document forms a legally enforceable contract
between you (the “Client” or “You”) and Alpha Estimation (the “Company,” “we,” “us,” or
“our”).
1. Introduction
At Alpha Estimation, we are dedicated to protecting your privacy and ensuring the maximum
safety and security of your personal data. This document explains how we collect, use, store, and
share your information and establishes binding service terms regarding our estimation services,
payment processing, and communications—including our integration with third-party providers
such as Stripe (for payments) and Zoom’s 10DLC SMS campaigns.
By using our website and services, you agree that:
• You have provided accurate and complete information.
• All payments are final and irreversible.
• You are bound by these Terms and cannot unilaterally cancel or back out once services
have been rendered or payments processed.

but not limited to, your name, contact details, and payment information.
• Services: The estimation services provided by Alpha Estimation through our website.
• Third-Party Providers: External companies (e.g., Stripe, Zoom) with whom we share

• SMS Campaign: Our text messaging service using Zoom’s 10DLC system to deliver
transactional and promotional messages.
• Irreversible Payment: A payment that, once processed, cannot be reversed, refunded, or
canceled without our approval.
• Applicable Laws: All relevant data protection, consumer protection, and contract laws.3. Data Collection & Use

Stripe.

experience, and secure our services.
C. How We Use Your Data
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

• Deliver Services: Provide, manage, and enhance our estimation services.
• Process Payments: Securely process payments via Stripe (all payments are final and
irreversible).
• Communicate: Send you service-related updates, SMS notifications (via our Zoom
10DLC campaign), and customer support messages.

• Comply with Legal Obligations: Fulfill regulatory requirements and contractual duties.
4. Payment Processing & Binding Contract
A. Payment Terms
• Finality of Payment: All payments made on our website through Stripe are final, non
refundable, and irreversible. By completing your transaction, you confirm that you have
verified all order details and agree to these terms.• Responsibility for Accuracy: It is your sole responsibility to provide correct and
complete information during registration, ordering, and payment. Alpha Estimation relies
on this data to deliver our services accurately. Inaccurate or incomplete information may
lead to service errors for which the Client is solely responsible.
B. Binding Nature of Contract
By making a payment and using our services, you enter into a binding agreement that includes:
• Non-Cancellation: Once payment is processed and services commence, you may not
cancel, withdraw, or back out of the contract.
• Data Registration: Your information will be registered with our third-party providers
(including for our Zoom 10DLC SMS campaign) and is non-retractable once consent and
payment are given.
• Client’s Obligation: You agree to honor these terms, ensuring that all data provided is
correct and that you fully accept the irreversible nature of transactions.
C. Contractor Bid Deadline & Refund Policy
• Bid Filing Deadline: Alpha Estimation is not liable if a Contractor misses the
opportunity to file a bid on time—regardless of the reason.
• Refund Conditions: No refund can be made after the delivery of the estimate. Refunds
are only applicable if the estimate is canceled within 2 hours of payment. Once our team
commences work on your project, no refund will be issued.
5. Third-Party Integrations & Data Sharing
A. Payment Processing via Stripe
• Secure Handling: All payment information is transmitted directly to and processed by
Stripe in accordance with their Privacy Policy. Alpha Estimation does not store sensitive
payment details.
• Data Use: Payment data is used solely to fulfill transactions and comply with applicable
financial regulations.
B. SMS Campaign via Zoom 10DLC
• Consent & Communication: By opting into our SMS services, you authorize us to use
your phone number to deliver messages using Zoom’s 10DLC system. Every message
includes clear opt-out instructions (e.g., “Reply STOP”).
• Data Registration: Data collected for SMS campaigns is registered with carriers via
Zoom. This data is used strictly for message delivery and compliance with industry
guidelines.C. General Data Sharing
We share your data only with trusted third parties who are contractually obligated to maintain its
security and use it solely for purposes necessary to operate our services. We do not sell or rent
your data to any external party.
6. Data Security & Retention
A. Security Measures
We deploy robust technical and administrative safeguards to protect your data:
• Encryption: Data is encrypted during transmission (using TLS 1.2 or higher) and at rest
(using AES-256 or equivalent).

8. Limitation of Liability & Indemnification
A. Limitation of Liability
To the fullest extent permitted by Applicable Laws, Alpha Estimation shall not be liable for any
and all claims, losses, damages, liabilities, or expenses arising from or in connection with the use
of our website, estimation services, or any related services. This includes, but is not limited to:
• No Liability for Irreversible Payments: Alpha Estimation is not liable for any claims or
damages resulting from irreversible payment processing.
• Service Disruptions: We are not liable for any losses due to technical issues, delays, or
failures in message delivery by third-party providers (e.g., Stripe, Zoom).
• Indirect and Consequential Damages: In no event shall Alpha Estimation be liable for
indirect, incidental, consequential, or punitive damages, including, without limitation,
loss of profits, revenue, or data.
• Force Majeure: Alpha Estimation shall not be held liable for any failure to perform its
obligations caused by events beyond its reasonable control, including natural disasters,
war, terrorism, labor disputes, or disruptions in telecommunications or internet services.
• Entire Risk Assumed by the Client: The Client acknowledges and agrees that all risks
associated with the use of our services are solely assumed by the Client, and Alpha
Estimation shall not be charged, fined, or held liable in any manner.
B. Indemnification
The Client agrees to indemnify, defend, and hold harmless Alpha Estimation, its affiliates, and
their respective officers, employees, and agents from and against any claims, liabilities, damages,
or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
• Your breach of these Terms.
• Inaccurate or incomplete data provided by you.
• Your misuse of our services, including violations of Applicable Laws or infringement of
third-party rights.
9. Governing Law & Dispute Resolution• Governing Law: These Terms are governed by and construed in accordance with the
laws of the State of Illinois.
• Jurisdiction:
o For Clients in Chicago: All disputes or legal claims arising from these Terms
shall be exclusively subject to the jurisdiction of the courts located in Chicago,
Illinois.
o For Clients Throughout the USA: These Terms shall be governed by Illinois
law, and any disputes shall be resolved through binding arbitration in Chicago,
Illinois, unless mutually agreed otherwise.
• Dispute Resolution: Any disputes arising out of or related to these Terms shall be
resolved through binding arbitration in Chicago, Illinois, or, if necessary, in the
competent courts of Chicago, Illinois.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining
provisions shall continue in full force and effect.
10. Amendments & Entire Agreement
• Modifications: We reserve the right to update or modify this document at any time. The
most current version will be posted on our website, and significant changes will be
communicated via email or a prominent notice.
• Entire Agreement: This document, together with any other documents expressly
referenced herein, constitutes the entire agreement between you and Alpha Estimation
regarding the use of our services.
11. No Solicitation & No Infringement
• No Solicitation: You agree not to use our services to engage in any form of unauthorized
solicitation of our employees, contractors, or affiliates. Any such activity may result in
immediate termination of your contract.
• No Infringement: You warrant that any information provided does not infringe on the
intellectual property or proprietary rights of any third party. Alpha Estimation shall not be
liable for any claims arising from such infringement.
12. Advanced Protective Provisions
• Strict Compliance: Clients must adhere strictly to these Terms. Any violation may result
in immediate suspension or termination of services, in addition to all legal remedies.• No Waiver of Rights: Failure by Alpha Estimation to enforce any provision of these
Terms shall not constitute a waiver of our right to enforce that provision or any other
provision in the future.
• Binding Arbitration & Costs: In the event of any dispute, all costs associated with
arbitration—including filing fees and attorney fees—shall be borne by the Client, unless
otherwise determined by the arbitrator.
• Review and Acknowledgment: By making a payment or using our services, you
acknowledge that you have read and fully understand these Terms, and that you accept
them without reservation.
13. Compliance Policy & Jurisdiction
• Compliance Policy: Alpha Estimation complies with all applicable federal, state, and
local laws, including data protection, consumer rights, and contract enforcement
standards. We maintain best practices in security, privacy, and service delivery consistent
with industry leaders.
• Jurisdiction for Chicago & the USA:
o For Clients in Chicago: All disputes or legal claims for Clients located in
Chicago, Illinois, shall be governed by Illinois law and exclusively subject to the
jurisdiction of the courts in Chicago, Illinois.
o For Clients Throughout the USA: For all other Clients within the United States,
these Terms shall be governed by Illinois law, and any disputes shall be resolved
via binding arbitration or in the competent courts located in Chicago, Illinois,
unless mutually agreed otherwise.
14. Communication Channels & Detailed Zoom Call Policy
Alpha Estimation employs multiple communication channels for service delivery, including but
not limited to phone calls, emails, SMS, WhatsApp messages, and Zoom calls. The following
terms govern the use of these communication mediums:
• General Communication:
o All communications (calls, emails, SMS, WhatsApp, and Zoom) are subject to
these Terms.
o You are responsible for ensuring that the contact information you provide is
accurate and current.
o By using these channels, you consent to receiving communications from Alpha
Estimation regarding service updates, project information, and support.
• Zoom Calls:o Purpose & Recording: Zoom calls may be used for consultations, project
updates, and support. These calls may be recorded for quality assurance, training,
and dispute resolution purposes.
o Confidentiality: Any sensitive information shared during Zoom calls will be
treated in accordance with our confidentiality obligations. However, clients are
advised that while we take all reasonable steps to secure communications, no
method of electronic communication is 100% secure.
o Client Responsibility: It is the client’s responsibility to ensure that any
information shared during Zoom calls is not of a confidential nature unless a Non
Disclosure Agreement (NDA) is in place.
